Terms & Conditions
1. GENERAL CONDUCT & STUDIO EXPECTATIONS
To maintain a safe and smooth training environment:
• Arrive 5–10 minutes before your class.
• Wear appropriate training attire and bring your own water bottle.
• Follow all coach instructions and studio guidelines.
• Late entry may not be permitted for safety reasons.
• Fitness In Motion (“FIM”) is not responsible for loss, theft, or damage of personal
items.
2. PACKAGE VALIDITY, PERIOD & ACTIVATION
2.1 Package Period & Free Class Entitlement
All class packages are governed by a fixed package period starting from the activation date.
Each package includes a defined number of free class entitlements that may be used within
the applicable package period, as specified at the time of purchase.
The package period and free class entitlement are fixed. Any unused free classes remaining
at the end of the package period will expire automatically.
2.2 Activation of Packages
• Packages are activated upon the customer’s request.
• All purchased packages must be activated within 7 days from the date of purchase.
• If no activation request is made, the package will automatically activate on Day 8.
• After activation, members may need to log out and back into GymMaster to refresh
the active package display.
2.3 Package Terms
• Packages, free class entitlements, and memberships are non-refundable, non-
transferable, and non-extendable (see limited exceptions below), except as required
by Hong Kong law.
• Class participation is subject to capacity limits and operational considerations.
• Unused free class entitlements after package period expiry are forfeited and cannot
be reinstated.
2.4 Package Period Expiry & No Extensions
Package periods are fixed and are not extendable.
Unused free class entitlements remaining at the end of the package period will expire and
cannot be carried forward, transferred, or reinstated.
2.5 Exceptional Circumstances (Serious Illness or Injury Only)
In exceptional circumstances only (such as serious illness or injury supported by reasonable
documentation), FIM may, at its sole discretion, review a request relating to package period
expiry.
Such requests must be submitted in writing as soon as practicable.All decisions made by FIM are final.
2.6 Package Shareability & Usage Limits
Package usage is limited to the number of individuals permitted under the applicable
package tier, as specified at the time of purchase.
The package holder is responsible for notifying FIM of all individuals authorised to use the
package. Once an active package has commenced, the list of authorised users may not be
changed or amended for the duration of that package period. Any changes will only apply to
future package purchases.
FIM reserves the right to require identification or verification of users for administrative and
compliance purposes.
2.7 Drop-In & Bulk Class Packages
Drop-in and bulk class bundles are governed by separate terms as specified at the time of
purchase.
Unless otherwise stated:
• Drop-in and bulk class bundles are non-shareable.
• Drop-in and bulk class bundles are valid for up to 120 days from activation or
purchase (as specified).
• Drop-in and bulk class bundles may not be combined with regular time-based
packages.
Unused classes in drop-in or bulk bundles will expire in accordance with the stated validity
period and cannot be carried forward or reinstated.
2.8 FIM-Initiated Class Cancellations & Compensation
Where a scheduled class is cancelled by FIM, FIM may, at its discretion, offer compensation
corresponding to the number of classes cancelled.
Compensation will be provided in the form of a bulk drop-in class bundle equivalent to the
number of cancelled classes.
This compensation mechanism is subject to the following conditions:
• The member must purchase a new time-based package for the compensation to
apply.
• The compensation bulk bundle must be activated at the same time as the newly
purchased package.
• The compensation bulk bundle will be subject to the standard bulk bundle validity
period of 120 days.
Compensation bulk bundles are not redeemable for cash, credit, or refunds and may not be
transferred or extended beyond their stated validity.

3. BOOKINGS, ATTENDANCE & CANCELLATIONS
3.1 Class Bookings
• Members are encouraged to book classes before 6:00 pm the day prior.
• Class bookings and attendance are managed through GymMaster.
3.2 Schedule Adjustments
FIM may adjust class times, instructors, or class types as needed.Where possible, notice will be provided.
3.3 Cancellation Policy
• Cancellations must be made at least 12 hours before class start time.
• Cancellations made later than 12 hours are treated as a No Show.
• Where a late cancellation or No Show occurs, the missed class will count toward the
package’s total free class entitlement for the applicable package period.
• Deductions for late cancellations or No Shows are not reversible.
4. HEALTH, SAFETY & PARTICIPATION
4.1 Health Declaration
Members are encouraged to undergo a medical check-up before engaging in physical
activity. Participation is voluntary and undertaken at the member’s own risk.
4.2 Member Responsibilities
• Declare any relevant health conditions, prior injuries, or chronic issues before class.
• Follow all coach instructions to ensure safe participation.
• FIM is not responsible for personal belongings or property loss.
4.3 Emergency Assistance
Members authorise FIM to arrange appropriate medical assistance when necessary,
including ambulance services, at the member’s cost.
5. WAIVER & RELEASE OF LIABILITY
5.1 Age Requirement
You must be 18 years old or above to consent to these Terms.
For participants under 18, a parent or legal guardian must consent on their behalf.
5.2 Implied Acceptance
By purchasing a package, booking a class, or attending any activity, it is deemed that you
have read, understood, and agreed to this Waiver & Release. Your participation confirms
acceptance of all associated risks and conditions.
5.3 Assumption of Risk & Release
You acknowledge that martial arts and fitness activities involve inherent physical risks. To
the fullest extent permitted by Hong Kong law, you release and discharge FIM, its owners,
officers, instructors, staff, agents, and all persons connected to FIM from any liability for
injury, loss, or damage — whether caused by ordinary negligence or otherwise — arising
from your participation, use of equipment or facilities, or presence on the premises.
5.4 Indemnity
You agree to take responsibility for your conduct and to indemnify and hold harmless FIM
from any claims, costs, or demands brought by you or third parties arising from your
actions.
6. PHOTOGRAPHY, VIDEOGRAPHY & PRIVACY
• FIM may capture photos and videos for documentation or marketing.
• Media may be used on print or digital platforms without compensation.
• You may request in writing to opt out; FIM will use reasonable efforts to
accommodate.
7. CHILD PARTICIPATION & SAFETY
7.1 Parental/Guardian Consent
Parents/guardians accept these Terms on behalf of their child.
7.2 Injury Responsibility
Parents acknowledge that injuries arising from participation are not the responsibility of FIM
or its coaching personnel.
7.3 Health Conditions
Parents must declare any relevant health conditions of the child before class.
7.4 Supervision
FIM is responsible for children only during scheduled class times.
Supervision before and after class remains the parent’s responsibility.
8. SPARRING, ADVANCED TRAINING & CONTACT SESSIONS
Sparring, advanced drills, and full-contact training involve increased risk. Participation is
voluntary and undertaken at the member’s own risk.
9. USE OF FACILITIES & MEMBER CONDUCT
• Use equipment and facilities responsibly.
• Members may be responsible for repair costs arising from negligent misuse.
• Sharing login credentials or allowing unauthorized account use is prohibited.
10. PAYMENTS, CHARGEBACKS & SETTLEMENT
All payments must be completed in full in accordance with FIM’s accepted payment
methods and procedures.
FIM reserves the right to suspend access to classes or facilities where payment has failed, is
reversed, or is subject to chargeback or dispute.
Any bank, card issuer, or third-party payment fees arising from chargebacks or reversed
transactions may be passed on to the member where permitted by law.
11. SUSPENSION, TERMINATION & REFUSAL OF ACCESS
FIM reserves the right to suspend or terminate a member’s access to classes and facilities,
without refund, where a member:
• Engages in unsafe, disruptive, abusive, or inappropriate conduct
• Fails to comply with studio rules or coach instructions• Misuses booking systems or engages in fraudulent activity
• Fails to settle outstanding payments
This clause is exercised in the interest of safety, fairness, and proper operation of the studio.
12. FORCE MAJEURE & TEMPORARY CLOSURES
FIM shall not be liable for any failure or delay in providing services due to events beyond its
reasonable control, including but not limited to government restrictions, typhoons, natural
disasters, power outages, facility repairs, or other force majeure events.
Where temporary closures occur, FIM may, at its discretion, determine appropriate
operational adjustments or compensation mechanisms in line with its policies.
13. HOUSE RULES, SAFETY & CONDUCT
Members must comply with all posted studio rules and safety guidelines, including but not
limited to hygiene requirements, appropriate footwear and attire, equipment use, and
respectful conduct toward staff and other members.
Coaches and FIM staff reserve the right to refuse participation or remove any individual
from a class where participation is deemed unsafe or disruptive.
14. PERSONAL DATA & PRIVACY
FIM collects and processes personal data for membership administration, class bookings,
and operational purposes, including through its booking and management systems.
By using FIM services, you consent to such processing in accordance with FIM’s Privacy
Policy, as updated from time to time.
15. GOVERNING LAW
These Terms are governed by the laws of the Hong Kong SAR.
16. UPDATES TO TERMS
Continued use of FIM services constitutes acceptance of updated Terms.
FIM may revise these Terms for clarity, operational needs, or safety requirements.
